HEALTH HOP PARTICIPATION WAIVER AND RELEASE OF LIABILITY

Please read carefully. When you sign this agreement you will waive certain legal rights, including the right to commence legal action.

In consideration of being permitted to participate in the Health Hop event (the “Event”) organized by Health Hop (“the Organizer”), I hereby acknowledge and agree as follows:

I confirm that I am at least eighteen (18) years of age and that my participation in the Event is entirely voluntary. I understand that the Event consists of visiting multiple independent fitness studios and travelling between those locations by foot, running, or other means of my choosing. I acknowledge that each fitness studio is independently owned and operated and may require separate waivers, and that such studios are not controlled by the Organizer.

I understand and acknowledge that a significant portion of the Event involves travelling between locations on public or private property, including sidewalks, roads, intersections, and other pedestrian or vehicular pathways. I further acknowledge that I am solely responsible for determining how I travel between locations, including route selection and navigation, even where suggested routes or guidance may be provided by the Organizer, and that I am solely responsible for my own safety during such travel.

I acknowledge that participation in the Event involves inherent risks and hazards, including but not limited to risks associated with running or walking in urban environments, motor vehicle traffic, cyclists, pedestrians, road and sidewalk conditions, weather conditions, visibility, navigation, fatigue, and physical exertion. I understand that these risks may result in serious injury, illness, or death. I freely and voluntarily assume all such risks, whether known or unknown.

I hereby release, waive, and forever discharge Health Hop, its owners, directors, officers, employees, contractors, volunteers, sponsors, partners, affiliated organizations, participating fitness studios, and any individuals or entities involved in organizing, hosting, sponsoring, or facilitating the Event (collectively, the “Releasees”) from any and all claims, demands, damages, costs, expenses, actions, or causes of action arising out of or related to any loss, injury, or damage that I may sustain in connection with my participation in the Event, including while travelling to, from, or between any locations associated with the Event, and including any claims arising from the negligence of the Releasees, to the fullest extent permitted by the laws of the Province of Ontario.

I agree that I am solely responsible for complying with all applicable laws, including traffic and pedestrian laws, and for exercising reasonable judgment while travelling between locations. I acknowledge that the Organizer provides no supervision, instruction, escort, transportation, or traffic control at any time during travel to, from, or between Event locations, and that I am solely responsible for my own safety, route selection, and conduct during such travel.

I agree to indemnify and hold harmless the Releasees from and against any and all liability, claims, demands, losses, or expenses, including legal fees, arising out of or related to my participation in the Event or my actions while travelling between locations.

I confirm that I am physically able to participate in the Event and have no medical condition that would impair my safe participation, or that I have consulted a qualified medical professional. I consent to receive emergency medical treatment if necessary and agree that I am responsible for any associated costs.

I understand that the Releasees are not responsible for any loss of or damage to my personal property.

I grant permission to Health Hop, its sponsors, partners, and affiliated organizations to photograph, film, and otherwise record me during the Event, including my likeness, image, voice, and participation (collectively, the “Media”). I agree that such Media may be used, reproduced, published, displayed, and distributed by the Releasees for promotional, marketing, advertising, and other lawful purposes, in any format or media now known or later developed, including but not limited to social media, websites, and digital or print materials, without further notice or compensation.

I understand and agree that I have no right to review or approve the use of such Media, and that all rights, title, and interest in and to such Media shall be owned by Health Hop or its designees. I waive any claims related to the use of such Media, including any claims for compensation, invasion of privacy, or infringement of moral rights, to the extent permitted by applicable law.

I agree that this Agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

By using this site or participating in a Hop you agree to act with reasonable care, follow venue rules, and accept the inherent risks of physical activity. A signed waiver is required to attend any Hop. While the waiver is available publicly for anyone to review or access, the only way to participate in a Hop is to have a completed profile with (a) signed waiver(s). When signing, it is acknowlegement that: I have read and understood this Agreement in its entirety, that I am aware that by signing this document I am waiving certain legal rights, including the right to commence legal action, and that I am signing it freely and voluntarily.
